Terms of Service

These terms are an agreement between you and Mafichoni Limited ("Mafichoni", "we", "us"), a company registered in Kenya, and govern your use of mafichoni.co.ke - including the Mafichoni Academy, the member portal, the talent marketplace, and the AI features on the site. By creating an account or using the site you accept these terms. Consulting engagements we deliver to clients are governed by their own written contracts; where those conflict with these terms, the engagement contract prevails.

1. Your account

You must provide accurate information when registering and keep your sign-in credentials confidential. You are responsible for activity under your account. You may sign in with email and password or with Google. Notify us promptly at info@mafichoni.co.ke if you suspect unauthorized use. You must be at least 18 to create an account.

2. Academy courses and payments

  • Course prices are shown on each course page. Payment is by M-Pesa or card, processed by Safaricom and Paystack respectively; access to paid course content is unlocked once the payment provider confirms your payment.
  • Your enrollment gives you a personal, non-transferable right to access the course for your own learning. You may not copy, resell, redistribute, or publicly share course content, or share your account so others can access courses you purchased.
  • If a payment issue occurs (for example you were charged but access was not unlocked), contact us and we will investigate and put it right. If you believe you are entitled to a refund, contact us within 14 days of purchase; refunds are assessed case by case and nothing in these terms limits your statutory rights under Kenyan consumer protection law.
  • We update course content over time and may retire courses; if a paid course you are actively taking is retired, we will offer a reasonable alternative or a refund for that course.

3. Certificates

Completing all lessons and passing all module quizzes in a course earns a Mafichoni certificate of completion. These certify that you completed the course and are verifiable at a permanent public link; they are not accredited qualifications, professional licenses, or CPD awards unless a course page expressly states an accreditation. You may share your certificate link freely; you may not alter a certificate or claim one that was not issued to you.

4. Talent marketplace

  • Talent profiles must be truthful - your skills, experience, and rates must be your own. We vet profiles before listing them, but vetting is a good-faith review, not a guarantee of any person's work.
  • Clients posting gigs must have authority to do so and must describe the work accurately.
  • Mafichoni facilitates matching between clients and talent. Unless we expressly contract otherwise, the resulting work relationship is between the client and the talent, and each party is responsible for its own contractual, tax, and legal obligations. AI-generated match suggestions are recommendations only.

5. AI features

The concierge chat, skills-gap diagnostic, and gig matching use artificial intelligence. AI outputs can be wrong or incomplete and are provided to help you navigate our services - they are not professional advice and are not a substitute for consulting us directly. Do not use the AI features to submit unlawful content or to attempt to extract other users' data.

6. Acceptable use

You agree not to:

  • break the law or infringe others' rights while using the site;
  • probe, scan, or test the vulnerability of the platform, attempt to bypass access controls, or interfere with its operation;
  • scrape content at scale, spam our forms or AI features, or send abusive volumes of automated traffic;
  • upload malicious code or misrepresent your identity or affiliation;
  • use course content, research, or site content to train or fine-tune machine-learning models without our written permission.

We may suspend or terminate accounts that materially breach these terms. Where reasonable, we will warn you first and give you a chance to remedy the breach.

7. Intellectual property

The site, courses, research, case studies, and branding are owned by Mafichoni Limited or its licensors and are protected by copyright and trademark law. Content you submit (a talent profile, a gig, a testimonial) remains yours; you grant us a non-exclusive license to host and display it on the platform for the purpose it was submitted. Third-party materials cited in courses remain their owners'.

8. Privacy

How we handle personal data is described in our Privacy Policy, which forms part of these terms.

9. Disclaimers and liability

The site and its content are provided with reasonable skill and care, but on an "as available" basis - we do not promise uninterrupted or error-free operation, and educational content is general knowledge, not advice for your specific situation. To the maximum extent permitted by Kenyan law, Mafichoni is not liable for indirect or consequential losses arising from use of the site, and our total liability in connection with the site is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including liability for fraud.

10. Changes and termination

We may update these terms as the platform evolves; the date at the top shows the current version, and material changes will be notified on the site. If you do not accept updated terms, stop using the site and, if you wish, ask us to close your account. You may close your account at any time by contacting us; paid course access ends when the account closes, subject to section 2's refund provisions.

11. Governing law and disputes

These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over disputes arising from them. We would rather fix a problem than litigate it - contact us first and we will make a genuine effort to resolve the issue.
